The other day, I went over what a Legal 2 Family by CO is.

A Legal 2 Family by Permit (aka, accessory apartment) home has to be owner occupied. One part of the home can be rented but you have to live in the other part of the home.

When you are purchasing a Legal 2 by Permit home in the Town of Babylon, those permits are not transferrable to the new owner. You have to apply for the permit once you take ownership.

The Town of Babylon will inspect the apartment so make sure you have a smoke detector in the bedrooms, in the hallway where the bedrooms are located and a CO detector. If you are missing these items, they will not approve you for the permit. The inspector will have to come back once you have installed the detectors and that could add on a few more weeks. Do it right the first time!

You even need a floor plan. It doesn't have to be perfect and the Town of Babylon supplies you with a sample floor plan in the application.

The permits are renewable every 2 years at $200.00 and $75.00 if you are a senior citizen (65 or over) you have to provide proof of age in that case.

If you are looking to purchase this type of home, going through the motions of the permit application is worth the rental income you will have!
