Town of Babylon Zoning - Q&A Corner with Jackie - What Are The Zoning Requirements For Fences?
Fences do not require a building permit as long as it meets the following guidelines:
- Maximum height allowance is 6 feet from the front of the house to the rear yard.
- Maximum height allowance is 4 feet in the front yard from the start of the house.
- Maximum height allowance of 3 feet for all fences constructed within 10 feet of either side of the ingress or egress of a driveway that use solid fencing as this can cause a sight obstruction.
- Maximum height allowance of 3 feet for corner lots within 20 feet of the corner.
Notice in the photo below, my clients installed a fence. See where the 3rd panel is higher? That is where it meets the beginning of the front of the house. If the first 2 panels were the same height, then that fence would be out of compliance.

The photo below shows a six foot fence on the left which starts from the front of the home. To the right of the home, the fence is also six feet and goes to the back of the home. If my clients wanted to put a fence in front of the home then it can't be higher than 4 feet.

Call the Town of Babylon Building Department (631-957-3058) if your fence does not meet the criteria above.
